1 Appellant, Robert Franklin Ray, hereinafter referred to as defendant, was convicted in the District Court of Oklahoma County, Case No. CRF 71-2691, of assault and battery with a deadly weapon with intent to kill, and sentenced to fifteen years imprisonment. Judgment and sentence was imposed on May 22, 1972, and this appeal perfected therefrom.
